Bill Tabled For Life Term In Paper Leak Conviction | Jaipur News

Jaipur: The Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) (Amendment) Bill, 2023, was tabled in the House on Tuesday. The Bill proposes to increase the maximum sentence for paper leaks to a lifetime from the existing 10 years.
Congress leader Sachin Pilot had demanded a strict law to prevent paper leaks and had taken out a yatra from Ajmer to Jaipur to this effect.
The government in its statement of objects and reasons said it is evident from incidents that offences relating to the use of unfair means are perpetrated by organised mafias and the existing provisions of punishment do not have a deterrent effect on them. Since a fair and reasonable recruitment process is adversely affected by such crimes, more stringent punishment for them is the need of the hour.
The state government enacted the Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022 to prevent and curb the offences of leakage of question papers and use of unfair means at public examinations for the purpose of recruitment to any post under the state government including autonomous bodies, authorities, boards or corporations.
Existing sub-section (2) of section 10 of the Act provides that if any person, including the examinee, whether entrusted or authorised with the conduct of the public examination or not, in conspiracy or otherwise indulges or attempts to indulge in unfair means or contravenes or abets to contravene any of the provisions of this Act, shall be punished with imprisonment for a term which shall not be less than five years but which may extend to imprisonment of 10 years.
They shall also be liable to fine not less than Rs 10 lakh and up to Rs 10 crore. In case of default of payment of fine such person shall be liable to be punished with imprisonment of either description for a term of two years.
