Bomb Blasts: Jaipur Serial Bomb Blasts Accused File Application For Their Release | Jaipur News

Jaipur: The accused in the Jaipur serial bomb blasts have filed an application in the special court for blast cases saying that though the high court has acquitted them in 8 cases the police have deliberately implicated them in the case of finding live bombs with malicious intent to keep them in jail.

Minhajul Haq, counsel for the petitioners said, under Section 300 of CrPC, if in any case the accused has been acquitted on the basis of the same facts and witnesses, another case cannot be run against them.
Besides, under Article 20 (2) of the Constitution of India, there is a provision that no person can be punished twice for the same crime. In this case, the accused have been sentenced once by the special court for bomb blast cases and the Rajasthan High Court has cancelled that sentence.

The application of the accused will be argued in court on August 11.
The accused have said in the application that in the Jaipur bomb blast case, the special court on December 20, 2019, sentenced four accused Saifur Rahman, Mohammad Saif, Mohammad Sarwar Azmi, and another minor (who was later considered a minor by the high court at the time of the incident) to death while one accused Shahbaz Ahmed was acquitted. Since the acquitted Shahbaz should not be released from jail, the police deliberately re-arrested the accused in the live bomb case registered about 11 years ago.
The high court acquitted all the accused on an appeal, cancelling the decision of the lower court on March 29 this year, but even today all the accused in the live bomb case are in jail, said the petitioner.
About 15 years ago, on May 13, 2008, 80 people were killed in serial bomb blasts in Jaipur one after the other. In these, 185 people were injured. Out of the total 11 accused in the blast case, 5 were arrested by Rajasthan SOG.
