Jaipur: While the state government has stepped up efforts in framing rules for the Right to Health (RTH) Act, the health activists alleged that the hospitals have now indulged into arm twisting to neutralise RTH law.

“The private hospitals have made suggestions in such a way that RTH will not affect them much. They have demanded legal provisions against patients filing frivolous complaints against doctors and hospitals. They are asking for the right to refuse notorious patients. They want to neutralise the RTH law,” said Chhaya Pachauli, the state coordinator of Jan Swasthya Abhiyan (JSA) Rajasthan.
The doctors’ bodies pointed out that they have made suggestions for seamless RTH Act implementation and for safeguarding rights of private hospitals. “If a patient indulges in violence, vandalisation and other such activities, the hospital should have the right to refuse such patients. We have demanded it for our safety and protection,” said Dr Sunil Chugh, president IMA (state branch).

Besides, they have demanded for legal provisions to penalise people doing frivolous and false complaints against doctors and hospitals.
The IMA has suggested, “These rights of residents of state under section 3 shall have binding on and apply only on public health care establishments, public health institutions and designated health care centres. For the purposes of subsection (c) and (d) of section 3, the meaning of health care establishment shall be any health care establishment set up, run, financed or controlled by the Government not by private, means public health care establishments only.”
They have further demanded, “For the purposes of subsection (c) of section 3, the meaning of health care establishment shall be public health care establishments, public health institutions and designated health care centres. In sub-rule B of Rule 4: insert in second line that responsibility of the on duty health care providers of public health care establishments, public health institutions and designated health care centres in emergency circumstances.”
“Penalise the individuals who are involved in fabricated complaints and misuse of grievance redressal system,” Jaipur Association of resident doctors representatives Dr Neeraj Damor and Dr Chitresh Shekhawat demanded from the government.
