JAIPUR: The state government on Wednesday tabled the advocate protection bill 2023 in the assembly which provides for a maximum sentence of seven years and Rs 50,000 fine in case of grievous hurt caused to a lawyer . The offence has been made cognisable, which means the offence is non-bailable. However, this will be limited to offences committed when the advocate is discarghing duties as an officer of the court in the court premises.
If a report is made to police by an advocate in respect to any offence against him or her, the police if necessary will have to provide protection, according to the bill.
In addition to the punishment of two to seven years’ sentence and fine ranging from 10,000 to Rs 50, 000 on the seriousness of the offence, the offender is liable to pay damages to the property of an advocate, and reimburse medical expenses as determined by court.
When a court imposes a sentence of fine or any other sentence of which the fine forms a part, the fine recovered will be paid as compensation to the advocate.
If a report of cognizable offence is received against the advocate for an act done during discharge of their professional duties, it can be registered only after a probe by a police officer not below the rank of deputy superintendent of police, and the inquiry should be completed in a maximum period of seven days. If a case is then registered, written information of the same must be sent to the Bar Council of Rajasthan.
