Supreme Court: Supreme Court Directive: Cabinet Committee and JDA Summoned for Contempt of Court | Jaipur News
Jaipur: The Supreme Court has considered as deliberate non-compliance of its orders by the cabinet empowered cabinet committee and JDA by putting conditions in the compliance of its order in a case related to the land acquisition for Loha Mandi in 2003.
The court has directed the JDA deputy commissioner along with the members of the empowered committee to appear in the court on November 28 and give this clarification.
The SC gave this order while hearing the special leave petition (SLP) of Moti Bhavan Construction Cooperative Society.
The members of the cabinet committee are UDH Shanti Dhariwal, industries minister Parsadi Lal Meena, revenue minister Harish Chaudhary, women and child development minister Mamta Bhupesh and minister of state for tribal affars Arjun Singh Bamania.
The court found that prima facie the orders of August 7, 2023, were deliberately not complied with. Abhishek Gupta, counsel for the petitioner said that the state government had acquired 10 bighas of land from the petitioner for Loha Mandi in 2003, but his award was not given.
An SLP in the apex court issued a notice to the parties and granted a stay in favour of the petitioner on July 23, 2018. While the matter was pending, a meeting of the cabinet empowered committee of the state government and the JDA was held on February 14 2021 and it was decided to give alternative land to the applicant in exchange of the land acquired. JDA also submitted an affidavit to this effect.
The Supreme Court directed JDA to carry out the decision taken by the empowered committee within three months on August 7 2023.
However, JDA imposed a condition on the petitioner that they should withdraw the pending SLP first, before land could be allotted.
The court took cognizance and issued notice.

The Maharashtra government has formed a nine-member committee to study the methodology used for including other castes in the Scheduled Tribe (ST) category. The committee, led by IRS officer Sudhakar Shinde, will visit Madhya Pradesh, Bihar, and Telangana to gather information. The Dhangar community, currently classified as Nomadic Tribes, is demanding ST status and a 7% quota. They claim a typographical error led to their classification as Dhangar in Maharashtra and Dhangad in other states. The committee must submit its report within three months.
