Electricity Connections, Prithviraj Nagar Scheme: No Power Connections Be Given To Society Leases At Prn: Hc | Jaipur News

JAIPUR: A single bench of Rajasthan High Court on Friday upheld the high court’s decision of not allowing the electricity connections on the society leases at the Prithviraj Nagar scheme.
Along with this, the court has also rejected the review petition of Jaipur Vidyut Vitran Nigam Limited and others in this regard.
The bench comprising Justice Sameer Jain gave this final order on Friday.Prior to that, the court, on May 24 had reserved the decision after hearing both the parties.
In the review petition against the July 2013 order of the high court, JVVNL said that due to non-release of electricity connections on those having lease from housing societies, there is loss of revenue worth crores every month due to electricity theft.
In such a situation, permission should be given to give proper electricity connections here. However, the Jaipur Development Authority said that if the electricity connections are given on society leases, JDA will suffer a loss of Rs 456 crore.
Advocate Prahlad Sharma appearing for petitioner Ashish Sharma and others said that under Section 43 of the Electricity Act, 2003, the occupants are also entitled to electricity connection.
“Electricity is also a fundamental right of a person. Apart from this, lakhs of connections in the city are given on lease without JDA. Therefore, there cannot be discrimination on this basis in Prithviraj Nagar,” said Sharma.
After hearing the arguments of all the parties, the court has rejected the review petition and upheld the high court’s previous decision of not granting electricity to society leases.

The bench emphasized that a coordinate bench cannot comment on the judgment of another bench of equal strength. This decision is significant as it comes amid discussions about whether the court’s previous verdict on the Prevention of Money Laundering Act needs to be re-examined.
Kabul House occupants ‘shut out’ despite high court orders
Despite a court order granting relief to occupants of Kabul House in Dehradun, the local administration has failed to unseal the premises, leaving residents, including elderly and children, to spend the night outside in the cold.
